Terms and Conditions for Golf Rental Homes

Welcome to Golf Rental Homes, LLC (the “Platform”), a booking service specializing in rental homes for golf travel groups. By accessing or using our website, mobile application, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of the Platform, whether you are a guest booking a property (“Guest”) or a property owner or manager listing a property (“Host”). If you do not agree with these Terms, you may not use the Services.

1. Nature of the Platform

Golf Rental Homes, LLC is a booking platform that connects Guests seeking rental homes for golf travel with Hosts offering such properties. We are not a property owner, manager, or real estate broker. We do not own, control, or manage the properties listed on the Platform, nor do we guarantee their condition, safety, or suitability. We provide a platform to facilitate bookings and communication between Guests and Hosts, but are not a party to any agreement between them.

2. Eligibility

To use the Services, you must be at least 18 years old and have the legal capacity to enter into contracts. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is accurate, complete, and current.

3. Roles and Responsibilities

3.1 Guests

  • Booking Process: Guests may browse and book properties listed by Hosts. All bookings are subject to availability and confirmation by the Host.

  • Compliance with House Rules: Guests agree to comply with all house rules, policies, and restrictions set by the Host, as communicated through the Platform or directly by the Host.

  • Liability: Guests are responsible for their conduct and that of their group during their stay. Any damage to the property or violations of applicable laws are the sole responsibility of the Guest.

3.2 Hosts

  • Listing Accuracy: Hosts are responsible for providing accurate, up-to-date information about their properties, including availability, pricing, amenities, and condition.

  • Property Condition: Hosts are solely responsible for ensuring their properties are safe, clean, and in the condition described in the listing. Golf Rental Homes does not guarantee or verify the condition of any property.

  • Compliance with Laws: Hosts must comply with all applicable local, state, and federal laws, including zoning, tax, and licensing requirements.

  • Guest Interactions: Hosts are responsible for all interactions with Guests, including resolving disputes, managing check-in/check-out, and addressing Guest concerns.

3.3 Golf Rental Homes, LLC

  • Platform Role: We provide a platform to facilitate bookings, but are not responsible for the actions, omissions, or performance of Hosts or Guests.

  • No Guarantees: We do not guarantee the accuracy of listings, the condition or safety of properties, or the behavior of Hosts or Guests. All bookings are made at the Guest’s own risk.

  • No Liability for Third-Party Actions: Golf Rental Homes is not liable for any disputes, damages, injuries, or losses arising from the actions or omissions of Hosts, Guests, or third parties.

4. Booking and Payment

  • Booking Confirmation: A booking is confirmed only when the Host accepts the Guest’s request and payment is processed through the Platform.

  • Payment Processing: All payments are processed through our third-party payment processor. Guests agree to pay the total amount shown at booking, including rental fees, service fees, taxes, and any additional charges (e.g., cleaning fees).

  • Service Fees: Golf Rental Homes, LLC charges a service fee to Guests and/or Hosts, as disclosed at the time of booking or listing. Fees are non-refundable except as provided in these Terms.

  • Currency: All payments are processed in U.S. dollars unless otherwise specified.

5. Cancellations and Refunds

  • Cancellation Policies: Each property has a cancellation policy set by the Host, which is displayed during the booking process. Guests are responsible for reviewing and agreeing to the applicable cancellation policy.

  • Platform Cancellations: Golf Rental Homes, LLC may cancel a booking in exceptional circumstances (e.g., fraud, safety concerns, or technical errors) and will notify affected parties promptly.

  • Refunds: Refunds, if applicable, are subject to the Host’s cancellation policy and processed through the Platform. Golf Rental Homes is not responsible for issuing refunds for cancellations initiated by Hosts or Guests.

6. Privacy and Data Protection

  • No Sale of Personal Information: Golf Rental Homes, LLC does not sell, trade, or transfer your personal information to third parties for marketing purposes. We collect and use personal information solely to provide and improve the Services, as outlined in our Privacy Policy.

  • Data Sharing: We may share your information with Hosts (e.g., Guest contact details for booking coordination) or as required by law. Please review our Privacy Policy for details.

7. Limitation of Liability

To the fullest extent permitted by law:

  • No Liability for Property Conditions: Golf Rental Homes, LLC is not liable for any issues related to the condition, safety, or suitability of properties listed on the Platform. Guests are responsible for verifying property details before booking.

  • No Liability for Host or Guest Actions: We are not liable for any acts, omissions, or disputes involving Hosts, Guests, or third parties, including property damage, personal injury, or failure to meet expectations.

  • Maximum Liability: In no event shall Golf Rental Homes, LLC, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any amount exceeding the fees paid to Golf Rental Homes, LLC in connection with the relevant booking.

8. Indemnification

You agree to indemnify, defend, and hold harmless Golf Rental Homes, LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your violation of any applicable laws or third-party rights; or

  • Any disputes between Guests and Hosts.

9. User Conduct

You agree not to:

  • Use the Platform for any unlawful, fraudulent, or unauthorized purpose;

  • Post or transmit any content that is defamatory, obscene, or infringing on third-party rights;

  • Attempt to interfere with the Platform’s functionality or security;

  • Misrepresent your identity or provide false information.

10. Intellectual Property

All content on the Platform, including text, images, logos, and software, is the property of Golf Rental Homes, LLC or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, modify, or distribute any content without our prior written consent.

11. Dispute Resolution

  • Between Guests and Hosts: Any disputes between Guests and Hosts should be resolved directly. Golf Rental Homes, LLC may, at its discretion, attempt to mediate but is not obligated to do so.

  • With Golf Rental Homes: Any disputes with Golf Rental Homes, LLC shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may suspend or terminate your access to the Services at our sole discretion if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary. Upon termination, your right to use the Services ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform or through other reasonable means. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

15. Force Majeure

Golf Rental Homes, LLC is not liable for any failure to perform its obligations under these Terms due to events beyond our reasonable control, including natural disasters, strikes, or government actions.
